Joodo recognizes that privacy is an important issue. We respect your right to keep the personal information you give us private.
We have designed and operate Joodo with the protection of your personally identifying information in mind. We do not share your information with anyone. This Privacy Policy outlines the types of personal information we gather when you use Joodo, as well as some of the steps we take to safeguard it.
OVERVIEW
This Privacy Policy describes the use by Joodo of the personally identifiable information given to Joodo by users of Joodo. By using the service, you agree to be bound by the terms and conditions of this Privacy Policy. If you do not agree with this Privacy Policy, please do not use or access Joodo.
INFORMATION THAT WE COLLECT
A. What personal information do we collect?
Joodo only collects your email address and name.We do not collect your social security number, credit card number or any other personally identifiable information, and we do not look at the content of any message or attachments you send through our service. However, we do collect information about your use of your computer and our service. We need this information in order to operate Joodo, but we do not share this data with anyone else.
B. When do we collect this information?
We collect this information when you first send files to other users using Joodo. If you use our default settings, you do not have to give this information to us again.
C. How will this information be used?
We will use your name and email address to show recipients of messages you send using Joodo that the messages came from you. We will also use it to send you a "blind" ("bcc") copy of each message you send through our service. Occasionally, we may use your email address to send you service updates directly regarding Joodo .
3.0 SHARING PERSONAL INFORMATION
We feel very strongly about keeping the information you give us confidential. We will not share the information we collect from
you with any third party. If we do ever contemplate doing so, we would send you notice and ask your permission first.
4.0 SECURITY
The security of your personal information is important to us. We take the following steps to secure the personal information we collect: All personal data contained in messages sent through the Joodo Service is encrypted during transmission to Joodo using industry standard authentication and encryption technologies. We protect the information you give us when you register or log in
to our service by putting it behind multiple levels of firewalls, with active intrusion detection systems.
5.0 CHANGES TO THIS STATEMENT
We may amend this Privacy Policy at any time by posting the amended terms on our website. All amended terms shall automatically be effective 30 days after they are initially posted on the Site. If we make material changes to this policy, we will notify you here, by email, or by means of a notice on our home page.
6.0 UNSUBSCRIBING
Joodo will provide a means for you to request removal of your contact information from our active databases. Such information will be deactivated as soon as reasonably possible in accordance with our deactivation policy and applicable law. However, we will retain in our files information you have requested to remove in some circumstances, such as to resolve disputes, troubleshoot problems and enforce our Terms of Service. Further, such prior information is never completely removed from our databases due to technical and legal constraints, including stored "back up" systems. Therefore, you should not expect that all of your personally identifiable information would be completely removed from our databases in response to your requests.
7.0 COLLECTING INFORMATION FROM CHILDREN
Personal information is not knowingly collected from children under the age of thirteen (13) and we ask that minors (under the age of 13) do not submit any personal information to us.
End User License Agreement and Terms of Use
All Joodo users must agree to an End User License Agreement and Terms of Use before installing Joodo software and using any Joodo services. The agreement is made within the Joodo software installation process. It is provided here for your information only.
JOODO SOFTWARE LICENSE AGREEMENT AND TERMS OF USE
This is a legal agreement between you, the end user, ("you" or "your"), and Joodo. By clicking on "I accept the terms in the License Agreement," you agree that you have read and understand this Agreement and will be bound by its terms and conditions. If you do not agree with the terms and conditions of this Agreement, click on "I do not accept the terms in the License Agreement"
and do not install or use this software.
Joodo grants to you a personal, non-commercial, non-exclusive, non-transferable, non-sublicensable, license to use Joodo software, with which this Agreement is provided, including any product documentation and any modifications, error corrections, bug fixes, new releases or other updates (collectively, the "Software") and the services and the network related thereto (collectively, the "Services") that may be provided by Joodo during the term of this Agreement.
Your use of the Software and the Services is subject to your compliance with all of the terms and conditions of this Agreement and the policies of Joodo as posted on its website from time to time, including without limitation Joodo' Privacy Policy. By installing and using the Software and the Services you acknowledge that you have read and agree to be bound by all such policies. Joodo reserves the right to modify or discontinue your access to the services, the distribution, posting or publishing of any content, or to change the terms of use or any Joodo policies at any time with or without prior notice.
As a condition of your using Joodo, you agree that you will not (a) use the software or the services to download, upload, post, publish, insert, attach, use, share with others or otherwise copy or distribute music, movies, images or other content for which you have not obtained all necessary rights from the owner or rightful licensor of such content; (b) modify content identifiers (such as the title or the name of the creator of that content) in order to disguise the origin or description of any content; (c) download, upload, post, publish, insert, attach, use, share with others or otherwise copy or distribute any content that is defamatory, harassing, obscene, invasive of another's privacy, or is otherwise illegal; (d) harm minors in any way, including without limitation by sharing, posting, publishing or downloading child pornography; (e) upload, share with others or otherwise distribute any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (f) interfere with or disrupt the Services or servers or connected to the Services, or disobey any requirements, procedures, policies or regulations of connected to the Services; (g) export or re-export the Software except in compliance with the export control laws of the United States and other relevant jurisdictions; or (h) collect any information about Joodo' network or users of the software or services by monitoring, interdicting or intercepting any process of the software or the services.
You agree to defend, indemnify and hold harmless Joodo from any violation by you of the terms of this Agreement.
Joodo reserves the right to change or modify your server storage limits at any time.
In order to use Joodo, you hereby grant permission for the software to utilize the processor and bandwidth of your computer for the limited purposes of (i) facilitating the transfer of digital files and communication between the users of the software and the services and (ii) facilitating the transfer of digital files to servers for purposes of posting content on the web.
The copyright, trade secrets and all other intellectual property rights in the software, product documentation and services (including any images, photographs, animations, video, audio, music and text incorporated in them) and all trademarks and trade names associated with them are owned by Joodo or its suppliers and are protected by the copyright, trademark and other laws of the United States and other countries and by international treaty provisions. You may not use any of them except as expressly permitted in this Agreement.
Joodo retains all rights not expressly granted in this Agreement.
Portions of the Software may contain software licensed from third parties and are subject to the terms and conditions of third party license agreements. You agree to comply with all such terms and conditions.
JOODO PROVIDES ALL CONTENT TO YOU "AS IS" AND "AS AVAILABLE." YOU ASSUME ALL RISKS IN ITS USE THEREAFTER. JOODO IS NOT RESPONSIBLE FOR THE ACCURACY, INTEGRITY, QUALITY, INOFFENSIVENESS OR LEGALITY OF ANY CONTENT MADE AVAILABLE BY USERS OF THE SERVICES. JOODO HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, WITH REGARD TO THE SOFTWARE AND THE SERVICES, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
JOODO DISCLAIMS ALL LIABILITY, EXPRESS AND IMPLIED, RELATED TO YOUR USE OF ITS SOFTWARE AND THE SERVICES. WITHOUT LIMITATION, YOU AGREE THAT JOODO SHALL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL OR OTHER INDIRECT DAMAGES, EVEN IF JOODO BECOMES AWARE OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE RECOURSE IN THE EVENT THAT YOU ARE NOT SATISFIED WITH THE SOFTWARE OR THE SERVICES OR IN THE EVENT THAT YOU SUFFER FINANCIAL OR OTHER INJURY OR DAMAGE IS TO CEASE USING THE SOFTWARE AND THE SERVICES. SOME STATES DO NOT ALLOW THE EXCLUSION OF ALL DAMAGES OR INDIRECT DAMAGES, AND IN SUCH EVENT, YOU AGREE THAT THE LIMIT OF JOODO NETWORK'S LIABILITY SHALL BE 1 dollar.
In the event that we receive notice that your use of Joodo (including without limitation, your distribution of content through any of the services) infringes the intellectual property rights of a third party or if you send material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive or encourages conduct that would be considered a criminal offense or that could give rise to civil liability or that otherwise violates any law, regulation, the terms of this Agreement or any of our policies, we reserve the right to terminate your use of the Software and the Services and to remove any files sent by you that are stored on our servers, with or without notice. We also reserve the right to decide whether content sent by you is appropriate and complies with this End User License Agreement. Upon any such termination, you will then cease any and all use of Joodo and will remove the software from all hard drives, and other storage media and destroy all originals and copies of the software in your possession or under your control.

Anti-Piracy and Security Commitment
At Joodo, we are committed to maintaining the privacy and security of our users and their content.
Joodo is intended to be used for peer to peer communications and content sharing. Joodo does not distribute adware and spyware with its application. Joodo expressly prohibits the use of its network and software for the illegal transmission of copyrighted material. Joodo will respond if notified by content owners to disable copyrighted material from being transmitted across its network. Joodo may disable individual accounts from its network if these accounts are found to be illegally transferring copyrighted material.
DMCA Policy
It is our policy to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws. Responses may include disabling a sender's ability to transmit material claimed to be the subject of infringing activity in Joodo format and/or terminating such sender's ability to use the Joodo application at all. If we take such measures, we will make a good-faith attempt to contact the sender who transmitted the content so that he or she may make a counter notification pursuant to sections 512(g)(2) and (3) of the DMCA. It is our policy to document all notices of alleged infringement on which we act. As with all legal notices, a copy of the notice may be sent to one or more third parties who may make it available to the public.
Infringement Notification
If you are a copyright owner or an authorized agent thereof and believe that any user of the Joodo application has infringed upon your copyrights, you may submit a notification pursuant to the DMCA by filing a notice of infringement with our Copyright Agent. To file a notice of infringement with our Copyright Agent, you must provide a written communication (by fax, regular mail or e-mail) that sets forth the items specified below. Please note that you will be liable for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is infringing your copyrights. Accordingly, if you are not sure whether material available online infringes your copyright, we suggest that you first contact an attorney. To expedite our ability to process your request, please use the following format (including section numbers):
1. Identify in sufficient detail the copyrighted work that you believe has been infringed upon.
2. Identify the material that you claim is infringing the copyrighted work listed in item #1 above or which you claim is the subject of infringing activity. You must identify each separate item of infringing material.
3. Provide information reasonably sufficient to permit Joodo to locate the material.
4. Provide information reasonably sufficient to permit Joodo to contact you (email address, telephone number and a mailing address).
5. Provide information, if possible, sufficient to permit Joodo to notify the user that allegedly sent infringing material (email address is preferred).
6. Include the following statement: "I have a good faith belief that use of the copyrighted materials in the manner complained of is not authorized by the copyright owner, its agent, or the law."
7. Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
8. Sign the paper.

You hereby acknowledge that if you fail to comply with all the of the requirements set forth above, your DMCA notice may not be valid.
Counter Notification
Pursuant to sections 512(g)(2) and (3) of the Act, the subscriber may make a counter notification. To file a counter notification with us, you must provide a written communication (by fax, regular mail or email) that sets forth the items specified below. Please note that you will be liable for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is not infringing the copyrights of others. Accordingly, if you are not sure whether certain material infringes the copyrights of others, we suggest that you first contact an attorney.
To expedite our ability to process your counter notification, please use the following format (including section numbers):
1. Identify the name of the Joodo file with respect to which Joodo has blocked access.
2. Provide your name, address, telephone number, email address, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or New York, NY, USA if your address is outside of the United States), and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) of the DMCA or an agent of such person.
3. Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that transmission of each .Joodo file identified above was blocked as a result of a mistake or misidentification of the material to be blocked."
4. Sign the paper.
